Malaysia Introduces New Overstay Management Program for Foreign Talent
Malaysia’s Immigration Department has implemented a new Overstay Management Program aimed at simplifying how foreign professionals and their dependents resolve short overstays. The initiative provides a more streamlined process, helping genuine expatriates avoid lengthy enforcement procedures for minor delays in renewing their passes.
A Simpler Process for Short Overstays
Under this new program, holders of Employment Passes (EP) and Dependent Passes (DP) who have overstayed up to 90 days can now settle the matter by paying a standard fine.
This means they no longer need to go through investigations or be referred to the Immigration Enforcement Division—an approach that significantly reduces processing time and administrative stress.
Key Changes to Note
- Direct Fine Payment for Minor Overstays
Foreign workers and dependents can resolve short overstays directly with immigration officers by paying the prescribed fine.
- Increased Special Pass Fee
The cost of the Special Pass, which allows temporary stay while awaiting approval decisions, has increased from MYR 100 to MYR 200 per application.
- Cases Not Eligible for the Program
The simplified procedure does not apply to:
Overstays exceeding 90 days
Repeat offenders
Existing Special Pass holders
Individuals with prior immigration offences
These cases will still be managed through the Immigration Enforcement Division and typically require company representatives and dependents to attend in person.
Recommendations for Employers and Expatriates
To prevent fines, delays, or enforcement procedures, companies and foreign nationals are encouraged to start the renewal or extension process at least three months before pass expiry.
Early planning ensures smoother processing and avoids unnecessary complications.
Who Has Announced the Implementation?
The Malaysia Digital Economy Corporation (MDEC) has officially confirmed that the Overstay Management Program is already in effect.
Although the Expatriate Services Division (ESD) has not released a formal announcement, they have begun applying the new procedures in line with the implementation.
